4. Intellectual Property Rights
All content, materials, and features available on the MapiDesk Platform, including but not limited to:

- Graphics, logos, icons, and design elements
- Software, code, and underlying algorithms
- Interactive tools, maps, and data visualizations
- Audio, video, and other multimedia content
are the exclusive property of MapiDesk or its licensors, and are protected by copyright, trademark, patent, and other intellectual property laws worldwide.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial educational purposes. You may not:
- Reproduce, distribute, modify, display, perform, or create derivative works from any content without prior written permission from MapiDesk.
- Use any content for commercial purposes, including but not limited to selling, licensing, or charging others for access to our content.
- Remove or alter any copyright, trademark, or other proprietary notices from any content.

5. User-Generated Content and Shared Links
The Platform allows you to generate shareable links containing encoded data about your study sessions, game progress, or map configurations. These links are created locally in your browser and are not stored on any MapiDesk server. The encoded data is decoded by the recipient's browser when they open the link.
By generating and sharing such links, you agree that:
- You are solely responsible for the links you create and share.
- You will not share links that contain unlawful, harmful, or objectionable content.
- MapiDesk does not moderate, review, monitor, or control these links and is not responsible for any content shared through them.
- You grant MapiDesk a non-exclusive, worldwide, royalty-free license to use, reproduce, and display any feedback, suggestions, or ideas you provide regarding the Platform, without any obligation to compensate you.
If you choose to subscribe to our newsletter, you are responsible for the content of any communications you receive and for maintaining the confidentiality of any login credentials (if applicable).
6. Third-Party Services and Links
MapiDesk integrates with and provides access to third-party services and resources, including:
- Map tiles: Provided by CARTO and OpenStreetMap.
- Fonts: Provided by Google Fonts.
- Advertising: We use Google AdSense to display advertisements (subject to our Privacy Policy).
- Newsletter delivery: We may use third-party email service providers to manage subscriptions.
These third-party services have their own terms of service, privacy policies, and data practices. MapiDesk does not control, endorse, or assume any responsibility for the content, availability, or practices of these third-party services. - Warranties that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
- Warranties regarding the accuracy, reliability, completeness, or timeliness of any information, content, or materials provided through the Platform.
You acknowledge that your use of the Platform is at your sole risk. Any content downloaded, accessed, or obtained through your use of the Platform is done at your own discretion and risk, and you will be solely responsible for any damage to your device or loss of data that may result.

8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAPIDESK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the Platform, including but not limited to damages for loss of profits, loss of data, loss of goodwill, business interruption, or any other intangible losses.
- Any errors, mistakes, or inaccuracies in the content provided on the Platform.
- Any unauthorized access to or use of our servers and/or any personal information stored therein.
- Any interruption or cessation of transmission to or from the Platform.

In no event shall MapiDesk's total liability to you for all claims arising out of or related to these Terms or your use of the Platform exceed the greater of (a) the amount you have paid (if any) to use the Platform in the past 12 months, or (b) one hundred U.S. dollars ($100.00 USD).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you. In such cases, MapiDesk's liability shall be limited to the fullest extent permitted by applicable law.
9. Indemnification
You agree to indemnify, defend, and hold harmless MapiDesk, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of, or inability to use, the Platform.
- Your violation of these Terms.
- Your violation of any applicable law, regulation, or third-party rights.
- Any content you share via challenge links or other means.
- Your interactions with other users (if any).
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.
10. Termination
MapiDesk reserves the right to suspend or terminate your access to the Platform at any time, with or without cause, with or without notice, and without liability to you. Grounds for termination may include, but are not limited to:
- Violation of these Terms or any other MapiDesk policies.
- Engagement in conduct that MapiDesk deems harmful to the Platform, other users, or third parties.
- Any unlawful or fraudulent activity.
Upon termination, all provisions of these Terms that by their nature should survive (including but not limited to intellectual property rights, disclaimers, limitation of liability, indemnification, and governing law) shall remain in effect. You may also terminate your use of the Platform at any time by discontinuing access.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes, claims, or controversies arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
You agree that any cause of action arising out of or related to the Platform must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
Notwithstanding the foregoing, MapiDesk may seek injunctive or other equitable relief in any jurisdiction to protect its intellectual property rights or prevent the unauthorized use of the Platform.
12. Force Majeure
MapiDesk shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure is caused by events beyond its reasonable control, including but not limited to natural disasters, acts of war or terrorism, government actions, labor disputes, internet or telecommunications failures, power outages, or any other unforeseen circumstances.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, consistent with the intent of the parties.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MapiDesk regarding your use of the Platform. They supersede all prior or contemporaneous communications, representations, or agreements, whether written or oral.
15. Waiver
No waiver of any provision of these Terms by MapiDesk shall be deemed a further or continuing waiver of such provision or any other provision. Any failure to enforce a right or provision does not constitute a waiver of that right or provision.
16. Assignment
You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without the prior written consent of MapiDesk. MapiDesk may freely assign or transfer these Terms, in whole or in part, without restriction to any affiliate or successor in interest.
